2. What is this notice for?

This notice is intended to inform you about how we collect, process and store personal data and how we track traffic on our website. FAIR SHARE’s goal is to collect data on the gender distribution in leadership positions of selected social impact organisations and publish it in the FAIR SHARE Monitor. The data collected or gathered for the purpose of publication in the Monitor will be on the name of the organisation and the gender distribution in staff and leadership positions.

For clarification, the data collected for the Monitor does not include personally identifiable information such as date of birth, name, or contact information for individuals holding leadership positions in the organisations listed.

3. What data do we collect and how do we process it?

The following outlines the different types of personal data we process, the sources for each type of personal data and the purpose and legal basis for processing the data.

Data submission for the FAIR SHARE Monitor
Organisations may provide us with information on the gender distribution of their staff and leadership. In this case, we process the contact details of the person submitting the data on behalf of the organisation (usually name, email address, organisation name) as well as information on the gender distribution in the workforce and in management positions. We do not hold any specific information on individual managers. In some cases, however, it may be possible to draw conclusions about a person from the figures provided alone.

The legal basis for the data processing described above is Art. 6 para. 1 sentence 1 lit. b GDPR, insofar as the data processing amounts to the conclusion of a cooperation agreement, or Art. 6 para. 1 sentence 1 lit. f GDPR, because we have a legitimate interest in processing aggregated data on women and other genders in management positions and publishing corresponding rankings and, if necessary, contacting you for this purpose.

Request by FAIR SHARE
If your organisation is part of the FAIR SHARE Monitor or is newly added, we will contact you with a request to provide information on the gender distribution in your leadership positions. For this purpose, we use contact data (usually name, position, name of organisation, email address), e.g. of an employee of your organisation, which we obtain from public sources. We process this data to send you the request. The legal basis is Art. 6 para. 1 p. 1 lit. b DSGVO, if the data processing amounts to the conclusion of a cooperation agreement, or Art. 6 para. 1 p. 1 lit. f DSGVO, because we have a legitimate interest in processing aggregated data on women and other genders in leadership positions and publishing corresponding rankings.

Contact form
If you contact us via the contact form, the information you provide in the form will be processed for the purpose of handling the request. The legal basis is Art. 6 para. 1 p. 1 lit. b DSGVO, if the enquiry concerns an existing or future contractual relationship, or Art. 6 para. 1 p. 1 lit. f DSGVO, because we have a legitimate interest in processing enquiries.

Candidate in our application process
When you apply to work with us in a paid capacity or as a volunteer, we process your contact details as well as the application documents provided by you in order to check your application and carry out the application process. The legal basis is Art. 6 para. 1 p. 1 lit. b DSGVO. If you have applied for a job at FAIR SHARE, we process your data while the application process is active, unless we are entitled or obliged to further processing.

Registration for events
When you register for one of our events, we process your name, position, contact details and the organisation you work for. We use this data to process your registration.

Newsletter registration
You can register for our newsletter with your e-mail address. The legal basis is Art. 6 (1) sentence 1 lit. a DSGVO as well as § 7 UWG. If you receive the newsletter from us, we may process your data until you inform us that you no longer wish to be on our mailing list.

The newsletter is sent using Mailchimp, an email marketing platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE Suite 5000, Atlanta, GA 30308, USA. MailChimp also uses this information to evaluate the newsletter. The legal basis is Art. 28 DSGVO in conjunction with the order processing agreement. The transfer of data to the USA is ensured by standard contractual clauses.

Donations
If you support us with your donation, we process your name and the amount of your donation. Furthermore, we may process your address in order to send you a donation receipt. The legal basis is Art. 6 para. 1 p. 1 lit. b, c DSGVO.

If you are an employee of FAIR SHARE, a candidate in our recruitment process, a volunteer, a partner, a member of FAIR SHARE or an organization submitting information to FAIR SHARE:

How long do we keep your data?

Unless otherwise stated, we keep your personal data only for as long as it is necessary for the purpose for which it is processed and then delete it, unless we are legally obliged to keep it for longer (e.g. to comply with legal retention obligations under tax law).

If you or your organisation are a partner of FAIR SHARE, we will process your data for the duration of the contractual relationship.

Who processes your data / is the data processed by third parties outside the European Economic Area?

Your data will not be disclosed to other parties outside FAIR SHARE unless specifically required by applicable laws or public authorities. We may also share your data with our trusted partners if the processing of your request or the provision of our services so requires (see above).

  • To request information about and access to your personal data and/or copies of that data in a as well as transfer of the personal data directly to another controller, where technically feasible;
  • To request proper rectification, erasure or restriction of your personal data;
  • To refuse and – without affecting the data processing activities that took place prior to the withdrawal or any other existing legal justification for the processing activity in question – withdraw your consent to the processing of your personal data at any time;
  • To take legal action in relation to a possible breach of your rights in the processing of your personal data and lodge complaints with the competent data protection authorities.
  • In addition to this, you have the right to object to the processing of your personal data at any time, provided that we are processing your personal data in pursuit of our legitimate interests and there are grounds arising from your particular situation.
  • Furthermore, you have the right at any time to unsubscribe from the Monitor mailing list or to unsubscribe from our newsletter or to request that you do not receive any further information from us.
  • If you wish to lodge a complaint about the processing of personal data, you should contact the competent authority in your country. In Germany, you can lodge a complaint with the Federal Commissioner for Data Protection and Freedom of Information.

How do we secure your data?

We consider all personal data we collect to be confidential. The network and equipment used by FAIR SHARE have been secured by appropriate measures to protect personal data from unauthorised access and accidental or unlawful destruction, alteration, disclosure, transfer or other unlawful forms of processing.

We reserve the right to update this privacy notice as we improve our website and operations. The updated notice will be made available on our website.
